Hi Peter1012, I am now starting to fight with Smartwings too. They have insufficient operating reserves between the flights and my flight was the sixth in the row with more than 3hrs delay. They are just maximizing utilization of aircrafts, which causes more and more cumulative delays. As I have received probably the same reply, I will contact the departure country CAA & will hope they will cooperate. I would use claims agency as a last resort solution, I would try to contact Spanish CAA regarding the real reason of the delay. Good luck!
