I'm not a lawyer, but in general you'll find that assault (and battery) statutes are written really, really broadly. (In fact, assault does not require contact -- if you swing your fist at a guy's face, and he ducks, it's assault). I'm not saying that every instance of simple battery is prosecutable, or even should be. What I am saying is that we shouldn't jump immediately to the conclusion that one side or the other is at fault / making "false accusations" / etc.
