A County Court case from 9 years ago is going to carry a lot less weight than a Supreme Court case decided today. But in any event since the first-line agents aren't really empowered to depart from BA policy it is about getting them to take a second look and checking whether the response meets BA's internal policy, and failing that to get a 'final response' email which you can use to go to CEDR.
