Whether or not you have the right to the seat - the other person certainly has less of a right to it. It doesn't matter if it is an advertised benefit because the other person has no right whatsoever to that seat.
Common courtesy is to ask if it is ok to move into an empty seat - and there is no shame whatsoever in saying no.
This is not DYKWIA - this is pushing back against pushy people.
Just so I understand, are you saying that if a passenger has paid for a seat (one seat) and the one next to them is unsold / unoccupied when the doors are closed, it becomes their decision whether another pax moves to that adjacent seat? Is that what you are saying?
