British Airways CEDR Complaint

Hi

Apologies if this is in the wrong section, first time posting.


Essentially I raised a complaint in regards to a delayed flight from LHR to ISB Flight BA261 from London Heathrow (LHR) to Islamabad (ISM) on 19 September 2023. The flight was delayed by flight arrived 287 minutes later than its PTA.

BA stated that it was delayed because, 'on the day you were due to travel, Air Traffic Control restricted operations into a block of air space your aircraft needed to travel through'. I went through the flight operations and EU261 and the reason provided by BA was insufficient. I escalated this to CEDR who stated I have a case. BA finally responded, after the deadline passed and extended it multiple times due to multiple and provided their reasonings.

They said the delays was due to ATC, airport handling, rotational delay, late positioning of the cargo they a
ccept responsibility for 118 minutes of the departure delay. The departure delay was less than 180 minutes though, and BA said '118 minutes were within our control. The flight was only delayed over 180 minutes because of the additional 138-minute delay incurred after departure'.

They provided their response letter, block times and additional files in regards to the route planning etc.

However, I feel they are pushing me down a different pathway as none of this classified as 'extraordinary circumstances'. I would be grateful if someone with expertise can help, I can share the relevant files BA sent to me. I tried to cram as much as info as possible.
