You are missing the whole point. It is not a technical issue and they can avail themselves but it is a Passenger Rights Issue. It is not the CAAP that is the safety regulator but CAB the Passenger Rights and Air services regulator that deals with it. They can divert too but they simply has to look after the passengers affected by this unscheduled stop.
Okay. I'm not familiar with what legal recourse the CAB affords to the OP in cases like this. Maybe the OP can ask PR to cover his additional out of pocket expenses.
