Today that is nowadays actually only true for uncultivated european rock oysters that are actually very hard to get by. Most cultivated and farmed oysters are steril and don't breed anymore and therefore can be eaten all year round. That's at least what I was told in Bretagne and also Scotland when I asked about this rule that I also knew about on oyster farms.
