I'm not sure what text on that page you are referring to; I've reproduced the conditions supplied with my last FB award booking - made 2 days before the cancellation fee was raised from €50 to €70 - and clearly, waiting until after the flight has departed is NOT a loophole to avoid paying the cancellation fee.

Presumably your ticket also has the same conditions, showing that a refund after departure of the 1st flight is allowed for a fee.
If you want to cancel and get your miles back, you will have to pay €70 regardless of when you cancel.
I would also caution that waiting until after departure of the first flight could mean that you forfeit the miles associated with that missed first sector.
If you are unsure whether you wish to travel, and you are only booking this ticket speculatively, then I would advise you in future NOT to book at all until you are certain you need the ticket if the €70 fee is a problem.
