I think this is an interesting to get to the bottom of. I also don't understand the negative reactions to this as surely people can benefit from having a final answer.
I don't take it personally though! It doesn't dissuade me!
BA (and other airlines) certainly has a history of misunderstanding this law, and there is no confirmation they haven't ceased misunderstanding it.
