Based on your logic, upgrades aren't a benefit at Hilton because some hotels don't provide them. The claim was that all hotel chains require you to pay tax on award stays, which is not the case, at least IHG covers it. If some individual hotel isn't aware of the rules, or chooses to ignore them, it doesn't change anything and I believe this could be quickly rectified via customer services.
You are entitled to your views as to what should happen, but it has been made abundantly clear as a factual matter that this is not an issue of "some random hotels" and that "customer services" is not rectifying this. The assertion was that this is a common practice, and there have been citations to numerous threads supporting that as a factual matter. Pointing to the IHG terms and conditions and your interpretation of them does not change that.
