U.K tax on upgrades if you return in less than 24 hrs?

I figure this forum is the perfect one for this question because a flight into LHR/LGW and departure in under 24 hrs would be more typical of a mileage runner weirdo (no offense intended...I count myself in that category ). I have read a posting in another forum which indicated that there are certain exceptions to payment of the 20 pound tax when you upgrade from coach on flights departing the U.K. One is if you're connecting in the U.K. on flights originating elsewhere. The other, which will effect me, is if you're in the U.K. less than 24hrs, e.g. JFK-LHR-JFK where you arrive around noon and depart in the morning the next day. Is that correct based on any personal experience you mileage runners have had?
