I've used my CPAP on Delta and nobody every said anything. Remember you only need batteries if you are going to use it on board, you are allowed to bring it on anytime without batteries.
I usually just leave it in my bag and put it on when I'm going to sleep. I didn't even know there was a rule, nobody has ever bothered me.
