thanks for replying. CAA guidelines and BA guidelines and policies don't give rise to a legal situation as such of course. BA could have guidelines/policy that alcohol was only served every third Tuesday to people called Geoff - but I am sure you acknowledge that whilst BA are free to have such a policy, it wouldn't have legal basis.

can you point to where in those laws it states what you claim? you have made quite a clear statement that Tobias-UK is wrong in stating "....away from licensed premises (where the Licensing Act 2003 does not apply) the legal age for consuming alcohol is 5 years of age. This means there is no prohibition in law for those aged 5 and older to consume alcohol on board an English registered aircraft.". I assume that with that level of certainty it should be quite easy for you?
