Not to be too pedantic about it, but they can arrest you and charge you practically on a whim. See Bad, Bad Leroy Brown case in Hawaii and Bookmark lady as examples.
To CONVICT you, of course the prosecution would need to prove all of the elements.
The odds of conviction are practically zero if SNA proceeds with the plan. The odds of arrest and jailtime before the justice system "quickly investigates" can take some time.
