Marriott laying groundwork to Waive Resort/Destination Fees For Elites

Was reading a Franchise Disclosure Document for an AC Hotel from March 2023 and discovered that they are now informing new franchisees that "You May be prohibited from charging destination and resort fees to certain tiers of loyalty programs reward members that stay in your hotel." This language was also in an FDD for a Westin Hotel in March of 2022, so this has obviously been in the works for awhile, but Marriott is clearly laying the groundwork for waiving resort/destination fees for some elite tiers. When and whether they do so, I have no idea, but if they do I would bet Titanium and Ambassador or maybe just Ambassadors will have the fees waived.

Does anyone know when they started inserting language like this in their FDD's?
