Well, first, if you checked out on 1 January having stayed the night of December 31 then all three nights will post to 2023 according to the T&Cs and that's how the IT implements it. The night of 1 January - 2 January is the first to post to 2024's count. You've been misinformed on this first point.

Second, you absolutely do not have to check out on 1 January to ensure that a stay straddling NYE posts the nights to the correct year. The Marriott system works out which EQN nights go to which year automatically. It would be absurd to force hotel guests in each and every room at Marriott's ~8,700 hotels around the world to check out and check back in on January 1 to ensure the correct posting of EQNs. So you've been misinformed on this second point too.

No "heads to roll" required.

If the stay does not post correctly according to these T&Cs, and you'll doubtless find an anecdote here where it hasn't, then you have a case to raise with customer service but let it post first before firing off the volcano. The only wrinkle to this is if the stay posts late in the new year for whatever reason then the EQNs will hit your annual total after the January 7 deadline for the selection of the ACB and it will default to SNAs. This is a separate discussion.

When your stay posts depends on the hotel. In Asia, all my stays post reliably around 2pm on the day after check out so in your scenario I would be confident of the stay posting around 2pm on 2 January. YMMV depending on the hotel and the region you are in.
