Which universe is that? The US Court (through their hired Canadian lawyer) has determined that an Alberta court would likely find the TOS enforceable. Alberta has not before, but other provincial level courts have.

I don't know about follow on claims or damages, but I can't see the courts (US or Canadian) going back on readily available and reasonable TOS not being enforceable.
