Speaking of packaging surcharges, I noticed in the fine print of my dinner order tonight that Black Bear Diner charges a 4% packaging fee via its online site, which wasn't present the last time I ordered there. I hadn't gotten takeout from there in a couple of years before tonight, however, so I don't know when they started charging. I did eat there with family a couple of months ago, and they didn't charge any packaging fee when asking for some to go boxes. I did adjust my tip accordingly.

Since it's not an all in price, I wonder if this will fall under California's new law?
