See "If you do not pay for tolls via available payment options, you will be charged for (a) all tolls incurred (at the highest, undiscounted applicable toll rate); (b) a $9.99 usage day fee; and (c) all other applicable toll charges or fees, if any."

It's the $9.99 per day fee even though you used it 1x that is getting you when you open the transponder. I certainly am not defending this outrageous fee Hertz is charging when you open the transponder - but they do show the terms and prices on that link above. The reason I know how not to get charged like this is I got nailed as you did 1x and had a conversation with the branch manager about how to avoid. Never open that transponder. If you do, $9.99 per day whether you use the darn thing again or not.

As for criminal, I'd love an Attorney General to get dinged like we have so they can stop this awful practice.
