Same problem and yes, the problem is meeting the claim deadline. For Chase CSR you have 60 days to report this incident and 100 days to file a claim form.
In my case I did not yet file a claim with Chase as (1) It was fault of 3rd party and (2) Avis said they would do so. Of course (2) is probably a lie.
I am going to reach out to Sedgwick to see if they have an active claim. I am told they lose a lot of them. Also I got a bill for cleaning so maybe they confused me with someone else. Then I guess I will file the incident report with Chase. Stay tuned.
Regarding the statute of limitations, the claim would presumably fall under breach of contract (if you failed to pay for damage as agreed in the contract) and they would have 3-8 years to file a civil action, depending on the state. Tort claims (for damage to property) generally have a shorter deadline starting on date of discovery.
