That actually makes a lot of sense as to how it happened. If I recall correctly, it was a full flight, like most ORD-EWR flights were, so this seems to be very likely. I always wondered how he got away with taking my pass.
This happened to me 4-5 years ago... Thought I would miss my flight, and they gave away my upgrade, but I made it running from connection. Got put in coach, fine, on the plane. I'm sitting in my exit row aisle seat (content because it's only a 90 minute flight) and a passenger boards at the end, walks up to me, and goes "You're in my seat, boy!" Thankfully I barely got through "Who are you calling..." before the gate agent was quickly standing behind her with my new boarding pass.
(I took my bag down and went up front... overheads full of course, F/A said he would put my bag in the closet and it disappeared from my sight... after we push back he hands me the receipt for a gate check tag, which did not make me happy. I had a projector in my bag which suffered damage - bag was a bit tight, but I didn't plan on checking it - and of course I got the whole "not responsible for electronics in checked bag" BS from the baggage service office....)
