It is if you're physically checking in and the FDA claims they don't have any suites available. Many have had success in this situation pointing to the inventory for sale.
You're correct that Marriott allows properties to exclude suites from the comp upgrade pool, though this is really a matter of a property-favoring interpretation of the T&C as opposed to something that is clearly spelled out. It's certainly not consistent with Marriott's marketing messaging.
