Hi Vacationtime1017 and welcome to FlyerTalk.

1). No, unfortunately (as is the case for any airline I am aware of), the equipment can be swopped at their discretion and there is no compensation for that.
2) It is way too early to say what actual frame will be used on that route and on that day. The newer configuration has only been retrofitted on a very small portion of the 77W fleet, so I would not count on it. The older configuration is certainly very far from class leading, but I personally can sleep well in those seats. The angle is very small and is partially offset by the 'nose up' aspect of the aircraft in flight. try to get a seat in the smaller from cabin (row 6 or 7) which gives a relatively private experience (especially compared with the somewhat 'dormitory' feel you can get on the A380.
