Question Rental Car Damage--LOSS OF USE

I returned a rental car to Budget recently (in Washington state), and they noticed a 2 inch long scratch/ding on the passenger side fender--I didn't notice it, so it must have happened in the hotel parking lot the night before.

American Express Optima Platinum paid for the damage, but there were two charges they did not cover:

1. A $50 "processing fee".

2. A loss-of-use charge. Although AMEX says that they pay loss-of-use charges, the actually only pay SUBSTANTIATED loss of use charges--in other words AMEX wants the rental car company to provide documentation that shows that the car would have been rented if it had not been in the shop. Budget refuses to provide the info (and I doubt that they can because they seemed to have a LOT of cars available). They claim that they are not required to provide that information in order to collect loss of use charges.

Which of these fees am I legally required to pay? Does anyone know for sure?
