However, the airlines do have a point in terms of them being expected to pay out compensation to passengers when none of this was their fault. Do NATS have to compensate the airlines for their losses?
As I understand it the purpose of UK261 is to give the passenger some weight in what is otherwise in power terms a very lopsided contract, betweeen airline and passenger.
The contract between airline and airport, or between airline and ATC, is not similarly lopsided and so does not need special statutory assistance.
