I appreciate your counsel which i will take into the future wholeheartedly. However just to be clear I never used those words re lawsuit and contract of carriage to the CSR. I used that language here on this site. I never got the opportunity to do so because as I said they walked away. Honestly if you feel this is about money it isnt. I dont want anything other than some sort of remedial action taken to prevent this happening in the future to me or any other passenger. However sometimes the only way to bring about a change in behaviour is to insist upon your strict legal rights. However with all sincerity I thank you for your guidance.
I am sorry to hear your situation. If things did happen as you have described, then its sure sounds like something were not right. I understand you are frustrated with what has happened. I think many of us have been in similar situations, if not necessary with airlines. You have mentioned about taking legal action. I am not a lawyer, or I am not in any sort of legal field, but many non-law associated people do have some idea how much legal action can cost. I think question you should ask yourself is how much scarify you are willing to make to yourself, both financially and personal time, to achieve the result you would like to see?
