The change removing DL Gold Amex from MQD Spend Waiver qualification was made over 3 years ago. You aren't the first one to miss the change (mainly due to the Covid status extensions), but it's probably time to move on at this point. Your "deceptive advertising" claims are going to have very little chance of success. Recommendation is to move on and get a card (DL Plat/Reserve Amex) that qualifies for MQD Spend Waiver.
