I guess my point is that if there is no statutory compensation requirement then, yeah, it's definitely cheaper not to have any fallback mechanisms and just screw over an occasional passenger.
IDB under the UK version of regulation 261 does not have a "not under BA's control" get-out clause. BA would need to pay IDB compensation. It might subsequently be able to look to HAL/UKBF/whoever for a contribution towards that, but that is none of the passenger's concern.
