What makes you say that there is no basis for litigation? Amex sets the terms but there is ambiguity in the wording to allows for different interpretations.

It refers to spending on the account. What is an account, if someone has multiple cards on their account?
You can definitely make an argument if someone spends a combined 75k on their Amex cards on a single account they should get lounge access.
Whether arbitration or court would agree with that interpretation is a separate matter. But I wouldn’t be surprised if that’s a reason for backtracking.
