If you are relying on LE v TAP then the key point to that case was that the traveller identified an alternative carrier and TAP refused to rebook. Now you don't have to emulate that exactly, but if TAP says "there were no alternatives from LIS" then you don't have a strong case. You best raise something here in FT immediately, since there are people around who can look things up on public tools and GDS. Now given all the LCCs that run into the two airports of Oslo I have no doubt that there was an alternative via say LGW or AMS or CPH etc but how do we prove now that there were seats available for sale?
