Correct. On my most recent trip, my flight was booked five days out - I was offered a business upgrade at purchase and accepted it. No upgrade was offered on the return trip, but when I got to the airport for the return, I asked if there were any seats available in business, and got one.

What was interesting is that ExpertFlyer was showing the return flight zeroed out across the board, but there were still seats available.
