We were rebooked on to a flight 25 hours later so will be able to claim hotel etc. However the booking was made using avois, are we entitled to any other compensation?
thanks!
Taken in isolation the 8724 was cancelled as it wouldn’t make the LCY closure, and as such it is listed as APRN.
HOWEVER -
The aircraft allocated was G-LCYM and it was assigned 5 sectors that day. 8732 LCY-FRA 8733 FRA-LCY 8722 LCY-GLA 8725 GLA-LCY and finally 8724 which was cancelled.
8732 suffered a minor delay, just 10 minutes, due to delayed boarding as a result of the Lufthansa starting up next door and the relevant ramp health and safety restrictions. It arrived in FRA just 6 minutes late with a bit of a thumper.
Next up 8733 and due to the heroic efforts of checking out the landing gear shock struts on the previous sector into FRA, a hard landing inspection was required. This gave a 1 hour and 39 minute delay to proceedings. 8733 arrived back in LCY some 90 minutes late.
8722 was next up and having made a sterling effort to minimise the reactionary delay and get it down to just 70 minutes, no one thought to generate an operational flight plan for the flight crew to use. Now I’m all for a bit of seat of the pant, wing and a pray time galavanting about, but I do that on my own on something small and puddle jumpy and, well, BA has policies against this sort of thing whilst on their aircraft and on the company’s time. So, it is a good idea to have some idea where it is they want you to take the aircraft and also their suggested method of getting there. The bright sparks and boffins finally finished their slide rule calculations at 3pm, which given the flight was scheduled to depart at 1pm must have been a result of getting the work experience kids in to do it. This generated a further 1 hour and 12 minute delay. 8722 left at 3.26pm, some 2 hours and 26 minutes late.
Inexorably this leads us to 8725, a much maligned service this particular day with a 2 hour and 11 minute reactionary delay, and then a slow cleaning process due to a shortage of cleaning staff provided for the task. The aircraft arrived back in LCY at 6:33pm, some 2 hours and 8 minutes late.
As a result of all of the above your flight, 8724, wouldn’t meet the curfew.
Due to the ARPN code, BA will reject the claim, but at CEDR with all of the above it should be rather swift work for the conclusion to be made that the delays that led to the cancellation were all entirely at the control of the airline. Once BA state their position won’t change follow the guidance on the EU/UK261 thread.
