Honestly I feel that the airlines should be allowed to file a claim against the Air Traffic control for some compensation when they delay flights. There really is no excuse for staffing issues and the management of Air Traffic control. For businesses to survive, clear rules and expectations need to be available.
In the normal course of business there would be SLAs in place and then they can sue for breach, but my guess is airlines have no options here - there's no SLA and you have to work with them, so, no recourse when they don't meet expectations.
