When this has happened here and I'm aware of it, then I always advise the poster to get a note on their PNR to say they are unhappy with being downgraded, or something similar, it's a part of BA's logic chain. But the actual requirement in the Regulation relates to whether the airline places you in J or not, which I think has happened here. It remains the case that MCOL is your best bet, but leaving it a long time before taking it further may perhaps count against you, there again the letters you wrote at the time would be in your favour.
