Seems like a very helpful corner of the internet! Was hoping to get some advice if possible.
Found myself in a situation with LOT airlines last month.
On Friday the 19th May I had a flight from Warsaw to London due to leave 10.15, after sitting on the plane until around 11.30 we were told it would not be leaving at all due to a faulty wheel. Upon exiting plane we were told a flight would leave at 18.30, and a follow-up email I received said 19:30 and an air stewardess told me that no seats could be guaranteed on any flight. Due to the delay, I would not be able to make my connecting trip, I was returning from Warsaw on the Sunday, and therefore I told the staff to cancel my booking and I would go home. The air stewardess told me to contact LOT to arrange to refund when I got home. Emails confirm the flight eventually left at 20.30.
Think the bit in bold is my massive error here.
I have complained to LOT who replied -
"Please be informed that according to the relating regulations, the passengers are entitled to compensation for a delayed flight only when they reach the final destination with delay of at least 3 hours. As you withdrew from the contract of carriage with LOT and did not reach your final destination, we find no grounds to resolve claim according to your expectations."
