Well, the lounge closes at 10pm which means they probably stop serving food & drink by 9:30pm (if not earlier), and with the 3-hour before departure rule you couldn't enter until 9:01pm anyway, so you're really not missing much, correct?
But yes, in theory, this is a dumb rule that should have an exception.
