Of course they could, but they haven't. It's no different from first class lines, where passengers have paid more but there is no legitimate difference between their risks or needs.
I'm sure TSA could shut down CLEAR if they wanted to. But they have no reason to, because it doesn't affect them, and it generates revenue for the airport authorities.
