I suspect you are not going to get BA to pay up, having reached a position on something like this they rarely change their minds. If they were reticketed on to the BA service to LHR and that service was delayed to greater than 5 hours at AMM, then article 8.1 applies, thus a refund. Provided the delay meant that there was no longer any purpose for the trip. In other words the AA delay wasn't the only delay here, and BA have to take their own responsibility. Because BA won't change their position you will need to take it to CEDR, focusing purely on the BA side rather than AA, or MCOL. Do not waste any more time arguing with BA about this. Does that mean abandoning trying to get the air fare reimbursed, do you think?
