I'm not sure if that was part of the script they've been told to follow, to reduce future calls, or if it was an agent winging it. I suspect most callers are more willing to accept "can't" than "won't," so it could also be an agent who's said "I'm not allowed to do it" in the past only to have the passenger cajole, demand a supervisor, etc.
But, yes, agents can put you into open PZ space if you have an upgrade instrument attached.
