I don't think this is so clear cut - I have certainly had 261 compensation for JFK-LHR-DUB where we missed the Dub flight and I was rebooked for the next morning and I never took it - arguing that it was a trip in vain at that point. I didn't argue for ORC though, so can't comment on that.
