And yes, the "fine print taketh away" but if one's financial position is such that phone replacement insurance is meaningful then they probably should not risk it by trying to run a scam that doesn't adhere to the actual terms and conditions laid down by the insurance provider in said "fine print" and depend on fighting it out in small claims court; suck it up and pay the $5 for using your credit card with autopay.
