The MAX MCAS disaster was, as I understand it, still the outcome of the computer being fed an incorrect algorithm, i.e. effectively still "human error". Things will get much trickier as AI makes inroads into (semi-)autonomous driving, flying etc. At that point the algorithm is no longer explicitly pre-defined by a human.
