My HLE on occassion gives me a car with less then full tanks. In all but one case, they noted it ahead of time and on the rental form. One time they did not, I called em on the cellphone from the parking lot and they adjusted it for me. No issues when bringing it back with that fuel level.
When I return the car, I always check the receipt, no matter how tight my schedule is. It is easier to fix it there on the spot then afterwards. So far, the worse that has happened is they forget to apply a CDP and they take care of it immediately.
As for a pre-emptive strike, contact the local Better Business Bureau.
Yeah, I think the moral of the story here is clear: I went with the Not Exactly company to save a couple bucks. I should have remembered those Hertz commercials! Very tempting at MCO with everybody offering such low rates and Hertz being a ways away from the airport.
Hertz is my usual company and that's why I clearly pointed out the intent: at Hertz, I've had problems with the CDP/PC - especially when using an online one from Hertz.com - and once in a while they forget my ZE1 or my Marriott Rewards number. But they fix it right there...no questions.
My experiences at HLE's is the same: they sometimes send out less-than-full cars, but I've never had a problem with a dispute on what was in there to begin with or what was there at the end. My neighborhood HLE is very good - never a complaint about them.
