Reading the article again, I think you need to pursue Delta and they as the non EU airline contracting for the EU airline can then seek to recover the amount from KLM.
KLM is handling agent for Delta they let me know so either way it is KLM I deal with. Informed them about the jurisprudence we found on this forum and let you know how it ended. The BRU UA case was for flights departing from an EU destiny, no reason why a connecting flight to an EU destiny on one ticket should be treated differently, but who knows KLM will argue the jurisprudence is not valid (yet) for my case...as said will let you know but this can take long.
