Well, jumping a red light or dropping litter in the street are criminal offences too. Let us keep a sense of proportion: failing to comply with an instruction from the captain to turn your phone off is not gonna land you in jail.
It depends, if a refusal to turn off the phone then escalates - either way, if you are met by the Police it’s sure as heck going to inconvenience you more than turning off a phone for a few mins
