I agree that the legally framework is the same, but there is a presumption against the necessity to purchase clothes, toiletries etc once you have returned home. Most airlines will deny claims for purchases made at origin/after travel is completed; either as a policy or on the basis that the necessity to purchase has not been proven.
The fact that LH baggage system is in meltdown is not the OP’s fault, the proposed purchase seems entirely reasonable to me, at least we agree the legal liability is the same & all claims should be justifiable
