I returned with like 15% and got charged the $35 fee (which honestly I didn't find unreasonable given how much time/money it would otherwise cost to charge it back to full). Not sure what would have happened if I returned it with <10%, but I didn't like my odds of being stranded to chance it that low.
Did you try to challenge the fee with Hertz as an undisclosed fee? I personally probably wouldn’t go to war with Hertz via chargeback (since I don’t want to end up on their DNR list), but they should at least be disclosing that fee. If enough people complain, that might be encouragement to fix it.
