We have to differentiate between LOs internal guidelines, which make rebooking easier for LO to handle, and the legal obligations and EC261. You are of course correct in regards to LOs internal guidelines.
EC261 does not require the passenger to accept LOs internal guidelines. It simply speaks of the next available flight without any mention of being on the same carrier. It is not the passenger's problem if LOs internal guidelines conflict with EC 261.
