And I just went to make a dummy reservation here and right at the top of the rates screen, in the blue "notices" box it says:
Please note - Daily destination fee USD 25 plus tax will be added to room rate-incl USD 25 food/beverage credit, 2 hour bike passes, 2 tickets to Freedom Trail, Fenway Park tour and Wi-Fi.
So seems to me they're in full compliance with the settlement here. Since this says it includes Wi-Fi, elite members who get free Wi-Fi anyway should also be getting an extra few points added on to compensate for that, per the Bonvoy T&Cs.
