An unusual but completely valid situation. I have met the criteria spelled out for a Qualifying Stay at both location. Is Marriott going to give me both?

Example 2
I am a sleazy business traveler and have a date with my mistress and have a room booked at a CY. My wife comes into town to surprise me so I quickly book another room across the street at the FI.

I have my date with the mistress and we fall asleep. At 3am I wake up and go across the street to join my wife and sleep the rest of the night there.

Why do I not get both stays? I met the criteria.

Example 3
I go to sleep at 9pm after a busy day. I am awoken by a party in the street at 11pm and it appears it will never end. The hotel says they are sorry there is nothing they can do, they would need to refund the entire hotel which they wont do.

I book a different hotel a few blocks away that is quieter. I then go there and go back to sleep.

Again met all the criteria, will they give me both?
I think you know the answer to all your entertaining scenarios though I appreciate the imagination that went in to creating them a lot more than your wife would appreciate finding a duplicate hotel reservation across the road from where she stayed on your Bonvoy account statement. You strip away the activity to the bare check in and check out information. The intent of Marriott's T&Cs is that you should only get one qualifying night per night however many mistresses you shack up with and whatever motivation you have to book a nested stay. What's needed is IT that deals with the overlapping check in and check out data and awards you just one elite night per night whether you used to room to nap in the afternoon, have an illicit encounter with a disreputable home-wrecker, or youths in the next room at the W have discovered beer for the first time. Whether the qualifying night is ultimately awarded for the master stay or the nested stay is irrelevant because you're only getting one qualifying night credited per night as long as the IT implements it consistently so members know what to expect on their account.

The T&C clause 2.1.d.iii found by @arlflyer appears to rule out getting points for the both stays too.
